Terms of Use

These terms apply to Birdie – Bird Identifier (the "App"), run by Michał Ciechanowicz, an independent developer based in Poland ("we", "us"). By using the App you agree to them. If you don't agree, please don't use the App.
If you got the App from Apple's App Store, Apple's Standard End User License Agreement also applies. If anything here conflicts with it, Apple's terms win for App Store users.
1. What Birdie does
Birdie identifies birds in photos with a model that runs on your phone, keeps a history and collection of the birds you save, shows information about each species, and lets you make shareable cards and Wrapped stories.
2. Identification is a best guess
Results come from a machine-learning model and can be wrong, especially for rare species, cage birds, poor photos and regions the model knows less well. Birdie is for hobby and learning. Don't rely on it for scientific records, conservation reports, legal matters, or decisions about wildlife or your safety. Please don't disturb birds, nests or habitats to get a photo.
3. Your account
- You must be at least 13 years old (16 in the EEA), or have a parent's or guardian's permission where the law requires it.
- Keep your sign-in details safe; you are responsible for what happens in your account.
- A guest account has no email or password. If you sign out of it or delete the App before signing up, you lose access to its collection.
- You can delete your account in the App at any time.
4. Your photos and notes
Your photos and notes stay yours. You give us a limited, non-exclusive, royalty-free permission to store, process and display them only to run the App for you (for example, to show your history or to make a card you choose to share). We don't publish or sell them.
Only upload photos you have the right to use, and nothing illegal or harmful.
5. Free plan and Premium
- The free plan includes a set number of identifications per day and a limited collection. The current limits are shown in the App and may change.
- Premium is an auto-renewing subscription (monthly or yearly) bought through the App Store or Google Play. Prices are shown in the App before you buy.
- Where a free trial is offered, it turns into a paid subscription at the end of the trial unless you cancel at least 24 hours before it ends.
- Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. Manage or cancel them in your App Store or Google Play account settings. Deleting the App doesn't cancel a subscription.
- Refunds are handled by Apple or Google under their policies. Your statutory consumer rights are not affected.
6. Fair use
Please don't reverse-engineer the App or extract its model or data, get around the free plan's limits, scrape or automate requests, or use the App to break the law or harm others.
7. Content from others
Species texts come from Wikipedia (CC BY-SA 4.0) and reference photos from Wikimedia Commons under each file's own licence; the App shows the source and author next to them. Physical data comes from Wikidata and AVONET (CC BY 4.0), and occurrence data from GBIF. The identification model is Google's AIY Birds V1 (Apache 2.0). Full credits are in the App under About. Everything else in the App (design, code, texts, mascot and the Birdie name) belongs to us.
8. Changes and availability
We work to keep Birdie running but can't promise it will always be available or error-free. Features may change. If we change these terms in an important way, we will tell you in the App before the change applies.
9. Liability
To the extent the law allows, we are not liable for indirect or consequential losses, for wrong identifications, or for decisions made based on the App. Nothing in these terms limits liability that can't be limited by law, or your rights as a consumer.
10. Ending
You can stop using Birdie and delete your account at any time. We may suspend an account that seriously or repeatedly breaks these terms. What happens to your data is described in the Privacy Policy.
11. Law
These terms are governed by Polish law. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can bring a claim in your local courts.
